Evidence was heard from the rider concerned who stated that he was holding onto nothing on the home turn and having checked for any challengers at that point, he did not check again until halfway between the final hurdle and the winning post. He admitted that he had declined applying any pressure to his mount as the gelding was tired but admitted that he should probably have finished third. Having viewed the recording and considered the evidence, the Stewards were of the opinion that D.J. McInerney was in breach of Rule 212 A (iv). Having taken his previous record into consideration, suspended him for 5 racedays and ordered that he forfeit his riding fee
